General Violations (the fine is calculated based on the number of employees of the company/holding):

 

  • Late submission of a reasoned notification to the Labor Inspectorate in case of exceeding the twelve-month duration of the posting or non-submission thereof.
  • Refusal to provide data or information by the service provider established on the territory of Greece or provision of inaccurate or false information or data regarding the posting of its employees to another member state
  • Non-submission by the company that posts employees to the territory of Greece to the Labor Inspectorate of the written declaration and status of the posted workers in the context of administrative cooperation and assistance with the competent authorities of other member states for the effective implementation and observance of the provisions of the posting of workers or late submission thereof
  • Non-submission or late submission of a supplementary statement by the company that posts employees to the territory of Greece to the Labor Inspectorate with the details of the change in details of the posting statement
  • Failure, during the posting, by the company posting employees to the territory of Greece at the place of employment (or at the business base if they are drivers) to provide copies (in paper or electronic form): a) of the individual employment contract or equivalent document, b) payroll slips or pay slips, c) attendance time slips, where the start, end and duration of the daily working time are indicated and d) proof of payment of wages or equivalent documents
  • Non-observance or non-sending, up to two years after the end of the posting, by the company posting employees to the territory of Greece of copies (in paper or electronic form): a) of the individual employment contract or equivalent document, b) of the notices payroll or salary settlement slips, c) time sheets, where the start, end and duration of the daily working time are indicated and d) evidence of salary payment or equivalent documents to the competent Services of the Labor Inspectorate within 15 days, from the date receipt of the application, if requested, or sending them late (very high)

Individual violations (the fine is calculated per victim):

  • Non-application by the company that posts an employee to the territory of Greece of the working conditions applicable to the posting.
  • Non-application by the company that posts an employee to the territory of Greece of the working conditions that apply to long-term posting.
  • Non-application by the company that posts a driver to the territory of Greece of the terms of employment applicable to the posting.
  • Violation by the company/employer that posts its employee to Greece of the obligation of non-unfavorable treatment, of the posted employee who exercises the right to legal protection and appeal before the competent administrative authorities because he considers that he has been damaged.
