OBLIGATIONS OF EMPLOYERS DURING THE EXECUTION OF CONSTRUCTION OR TECHNICAL WORK

‘Obligated employers’ means natural or legal persons who are obligated:

  1. to prepare an inventory of construction work;
  2. to submit a Detailed Periodic Statement (APD) and to pay social security contributions.

In private technical works and in public works, employers are obligated:

  • to announce the staff employed through the ERGANI information system Ε12 – e‑ΟΙΚΟΔΟΜΩ [E12 form – e‑IKODOMO]’ (before the start of each day’s work) and to keep a copy of the announcement form for each day of employment of the staff in question at the project work-site.

In private technical works, the responsibility lies with the project owner and all intermediaries. In public works, the responsibility lies with the contractor who has undertaken the project, while in works carried out with direct labour, the responsibility lies with the representative of the public body.

In private construction works, works carried out with direct labour and works under the ‘antiparochi’ (‘flats-for-land’) system, employers are obligated:

  • to log the announcement of employed staff in handwritten form every day or on computerised pages printed in book form at the project worksite, in the Log of Daily Reports of Staff Employed in the execution of construction and technical works (VIDAP);
  • to announce the staff employed through the ERGANI information system, ‘E12 form – e‑IKODOMO APOGRAFIKO’ on a monthly basis until the last day of the following month of employment.

In private works, the responsibility for the building lies with the owner or joint owners, while for the plot/under the ‘antiparochi’ system, the owner or joint owners and the contractors are jointly responsible.

NOTES:

  • In cases of minor repairs, the responsibility lies with the employers-residence owners; the foregoing do not apply if a construction work permit is not required.
  • It is forbidden to employ minors without a work booklet and to assign tasks prohibited for them (unhealthy environment in construction and technical works, Government Gazette, Series II, No 875/2003).
